We found that numerous domains containing the name CDS22, with both national and supranational extensions, had been registered within the same period of time. Several of those registrations were also traceable to individuals or companies operating in our own commercial sector.
This finding made it necessary for us to act in order to protect the digital identity of CDS22-formula and to prevent possible confusion as to the origin of the information, the contact details and the products.
Protecting the De Simone Formulation means safeguarding not only Prof. Claudio De Simone’s original probiotic formulation, but also the name by which it is known today and the addresses through which consumers, professionals and partners can identify and reach the official channels.
Domain recovery procedures vary from country to country. We are working to defend the name CDS22-formula domain by domain, and we will update this page with each new result.
The CDS22-FORMULA trademark was filed by Prof. Claudio De Simone on 31 May 2024. Just eleven days later, on 11 June, cds22.it was registered by Hostpoint AG.
By decision of 4 June 2026, the Milan Chamber of Arbitration upheld Prof. Claudio De Simone’s complaint, finding:

In the section devoted to the complainant’s allegations, the decision reports that some of these domains „would appear to be registered in the name of Mr Salvatore Orlando, legal representative of the company Mendes S.A., which operates in the same commercial sector and in a relationship of competition with the complainant.“

The Panel concludes:
„The circumstances set out and documented in the complaint provide sufficient elements to hold the Registrant’s bad faith to be proven.“
And orders:
„Upholding the complaint, the Panel orders the reassignment of the domain name ‹cds22.it› to Prof. Claudio De Simone.“
Im Rahmen der Maßnahmen zum Schutz der Rechte im Zusammenhang mit dem Namen CDS22- formula wurde bei Nominet UK ein förmlicher Antrag auf Zugang zu den Registrierungsdaten der Domains cds22.uk und cds22.co.uk gestellt.
Nominet UK hat die Daten des Domaininhabers der beiden Domains förmlich mitgeteilt; daraus ging hervor, dass beide Domains auf denselben Dritten registriert waren, der den offiziellen Kanälen von CDS22-formula nicht zuzurechnen war und nicht zur Nutzung des Namens CDS22-formula berechtigt war.
Nach Ablauf und Nichtverlängerung der Registrierungen durch den bisherigen Domaininhaber wurden die Domains zurückerlangt und auf den Namen von Prof. De Simone registriert.
Die Rückerlangung der UK-Domains schließt an die Entscheidung der Mailänder Schiedskammer zu cds22.it an und stellt einen weiteren Schritt zum Schutz der digitalen Identität von CDS22-formula dar.
